Issue 404 Error

Is there a way with TBS to issue a Page Not Found 404 Error when mergeblock returns no data? Basically my template is pulling strictly from a DB and when no rows are returned I would like to just issue a 404 error message.

No. This is not possible. TBS send no HTML header.
